About The Service

Rape & Sexual Assault

If you’ve been accused of rape or a serious sexual offence, the impact can be overwhelming. Your reputation, career, family life and liberty are all at risk. You need specialist, discreet and proactive legal representation immediately.
At Powell Spencer & Partners, our experienced criminal defence solicitors in London provide robust, confidential representation for clients facing rape allegations and serious sexual offences across England & Wales.

Why You Need Specialist Rape Defence Solicitors

Rape and serious sexual offences are among the most serious charges in criminal law. A conviction can mean:

  • A lengthy prison sentence

  • Mandatory registration on the Sex Offenders Register

  • Loss of employment and professional standing

  • Immigration and travel consequences

  • Long-term reputational damage

These cases are often complex and highly sensitive, involving issues of consent, intoxication, digital evidence, historic allegations and credibility. Having specialist defence solicitors from the outset can make a crucial difference to the outcome.

Why Choose Powell Spencer & Partners?

  • Specialist serious sexual offence defence – We regularly act in rape and serious sexual offence cases in the Magistrates’ and Crown Courts.

  • 24/7 emergency representation – We can attend the police station day or night if you are arrested or asked to attend a voluntary interview.

  • Strategic, evidence-based approach – We examine every aspect of the prosecution case: CCTV, phone downloads, messages, social media, forensic and medical evidence, witness accounts and disclosure.

  • Sensitive, discreet handling – We understand how stressful and embarrassing these allegations can be. Your case will be handled with utmost confidentiality and care.

  • Legal aid & private funding options – Many rape cases qualify for legal aid. Where they do not, we offer clear, structured private fee options.

What Is Rape in Law?

Under the Sexual Offences Act 2003, rape generally involves intentional penetration of another person’s vagina, anus or mouth with a penis, where the complainant does not consent and the defendant does not reasonably believe there is consent.

Related serious offences include:

  • Assault by penetration

  • Attempted rape

  • Sexual assault

  • Causing a person to engage in sexual activity without consent

Even an allegation – before any charge – can have serious personal and professional consequences. Early legal advice is vital.

Common Situations We Deal With

We regularly advise and represent clients in situations such as:

  • Allegations arising from a relationship or former relationship

  • Complaints made after a one-off encounter (including after nights out or dates)

  • Allegations involving alcohol or drugs, where capacity and consent are disputed

  • Historic rape allegations, sometimes raised years after the alleged events

  • Cases involving digital evidence – messages, dating apps, social media, images and videos

  • Cases where you believe you are facing a false allegation or a serious misunderstanding

How We Defend Rape Allegations

Every case is different, but defence strategies often include:

1. Challenging Consent and Reasonable Belief

We examine all the surrounding circumstances – communications before and after, behaviour on the night, witness accounts, intoxication and inconsistencies – to show consent or a reasonable belief in consent.

2. Testing the Complainant’s Account

We carefully analyse the complainant’s statements, previous accounts, social media and any inconsistencies or contradictions in their evidence.

3. Using Digital and Forensic Evidence

Modern rape cases often turn on digital and forensic material:

  • Phone downloads and messages

  • Dating app records

  • CCTV footage

  • DNA and other forensic evidence

We work with appropriate experts to ensure this material is properly examined and, where necessary, challenged.

4. Establishing an Alibi or Alternative Explanation

Where appropriate, we gather evidence that you were elsewhere, that events occurred differently, or that any physical contact was not non-consensual.

5. Early Written Representations

In many cases, especially at the pre-charge stage, we can prepare detailed written representations to the police or CPS, arguing that there is insufficient evidence to charge or that it is not in the public interest to proceed.

Representation at Every Stage

Police Station & Pre-Charge Stage

If you are arrested or invited to a voluntary interview:

We will:

  • Advise on whether to answer questions or give a prepared statement

Charged & Court Proceedings

If you are charged:

  • We advise on plea, likely sentence range and all available options

  • We obtain and review all prosecution evidence

  • We identify weaknesses in the case and any abuse of process

  • We instruct experienced Crown Court advocates and barristers where necessary

  • We prepare you thoroughly for trial or for sentencing if you plead guilty

Post-Conviction Advice

If you have already been convicted:

  • We can advise on appeals, sentence reviews and fresh evidence

  • We explain your obligations under the Sex Offenders Register

Legal Aid & Funding

Because of the seriousness of rape allegations, many cases qualify for criminal legal aid, subject to means and “interests of justice” tests.

FAQs – Rape Allegations Defence

Q: I’ve been accused but not yet charged – do I really need a solicitor now?

Yes. Early advice at the pre-charge stage can significantly affect whether charges are brought and how strong your defence will be if the case proceeds.

Q: Will my name be in the press?

In many cases, complainants are given anonymity, not defendants. We can advise on engaging with the media and steps to help protect your privacy where possible.

Q: Do I have to answer police questions?

You have a right to silence but there can be tactical reasons to answer some questions. You should never decide this without speaking to a specialist solicitor first.

Q: Can I get legal aid for a rape case?

Often yes. Rape and serious sexual offences generally meet the “interests of justice” test. We will assess your eligibility and help you apply.
